ARMTED PAID SERVICES TERMS

1. ABOUT THESE PAID SERVICES TERMS

These Paid Services Terms (“Paid Services Terms”) govern the purchase and use of paid services, paid features, promotions, verification services, advertising services and other paid functionality made available through or in connection with ARMTED (“Paid Services”).

These Paid Services Terms supplement the ARMTED Terms of Service. By purchasing a Paid Service, you agree to these Paid Services Terms and to the other ARMTED terms and policies applicable to the relevant service, content, account or activity.

If there is a conflict between these Paid Services Terms and the general Terms of Service concerning a Paid Service, these Paid Services Terms will apply to the extent of that conflict, unless otherwise stated.

Additional terms, descriptions or conditions presented to you before purchasing a particular Paid Service also form part of the terms applicable to that purchase.

Nothing in these Paid Services Terms limits any rights that cannot lawfully be excluded or limited under applicable law.

2. PAID SERVICES

ARMTED may offer different Paid Services from time to time.

Paid Services may include, without limitation:

  • paid publication or activation of listings;
  • Promoted Listings;
  • listing bumps or similar visibility enhancements;
  • Promoted Posts;
  • Promoted Events;
  • advertising and sponsored content;
  • paid functionality for ARMTED Partners and business users;
  • paid packages or bundles of ARMTED functionality;
  • user profile verification;
  • firearm or firearm-related item verification;
  • booking-related fees or paid booking functionality;
  • enhanced visibility, placement or presentation of content;
  • additional account, business or content functionality; and
  • other paid digital services or features introduced by ARMTED in the future.

The availability, functionality, eligibility requirements, duration and price of individual Paid Services may differ by market, platform, account type, content type or other relevant circumstances.

ARMTED is not required to make every Paid Service available to every user, in every market or on every platform.

3. NO AUTOMATIC RENEWAL

Unless ARMTED expressly introduces a different product in the future and clearly informs you of its terms before purchase, Paid Services covered by these Paid Services Terms do not automatically renew.

A Paid Service purchased for a specified period expires at the end of that period without automatically charging you for another period.

If you wish to continue using such a Paid Service, you may be required to purchase it again.

The introduction of any automatically renewing service in the future would require the applicable renewal conditions, price, billing frequency and cancellation rules to be disclosed before purchase.

4. PRICES

ARMTED may determine and change the prices of Paid Services at its discretion, subject to applicable law.

Prices may vary depending on factors including:

  • the type of Paid Service;
  • duration;
  • market or country;
  • currency;
  • account type;
  • whether the customer is a consumer or business;
  • applicable taxes;
  • promotional offers;
  • content category;
  • placement or visibility offered;
  • platform through which the service is purchased; and
  • other characteristics of the relevant service.

A price change does not retroactively change the price of a Paid Service that you have already purchased, unless required or permitted by applicable law.

The price displayed to you immediately before you confirm a purchase is the price applicable to that purchase, subject to any obvious pricing error and applicable mandatory law.

5. TAXES, VAT AND CURRENCY

Before completing a purchase, ARMTED or the applicable payment provider will display the relevant purchase information, which may include:

  • the price;
  • currency;
  • applicable VAT, sales tax or other taxes;
  • whether the displayed amount includes or excludes applicable taxes;
  • the duration of the Paid Service; and
  • other material conditions of the purchase.

The presentation of prices, taxes and VAT may vary depending on your jurisdiction and whether you are acting as a consumer, business or other type of customer.

Business users are responsible for providing accurate billing and tax information where requested.

Where required by applicable law, ARMTED may collect VAT, sales tax or other taxes in connection with a transaction.

6. PAYMENT

Paid Services may be paid for through payment methods and third-party payment providers made available by ARMTED.

These may include payment processors, payment platforms, app stores or other payment service providers.

The payment methods available to you may depend on your country, platform, currency, account type or the Paid Service being purchased.

Third-party payment providers may apply their own terms, privacy policies and payment processing requirements.

ARMTED may add, replace, restrict or discontinue payment methods or payment providers at any time, subject to applicable law and without affecting rights relating to purchases already completed.

You must provide accurate and authorised payment information and may not use a payment method fraudulently or without the permission of the authorised holder.

7. WHEN A PAID SERVICE BEGINS

Unless otherwise stated before purchase, a Paid Service may begin immediately after successful payment or confirmation of the purchase.

For time-limited Paid Services, the applicable period normally begins when the service is activated, unless a different starting point is clearly stated before purchase.

Technical processing may require a reasonable period before a Paid Service becomes fully visible or operational.

ARMTED may delay activation where reasonably necessary, including for:

  • payment verification;
  • fraud prevention;
  • account or identity verification;
  • content review;
  • compliance review;
  • technical processing; or
  • verification of eligibility for the relevant service.

8. PROMOTED CONTENT AND VISIBILITY SERVICES

ARMTED may provide Paid Services that increase, modify or prioritise the visibility of content, including listings, posts, events, profiles or other eligible content.

Depending on the service purchased, ARMTED may provide enhanced placement, increased distribution, highlighted presentation, prioritisation, resurfacing or other promotional treatment.

The specific promotional treatment may vary depending on the product description presented before purchase.

9. NO GUARANTEE OF RESULTS

Purchasing a promotional, advertising, visibility or similar Paid Service does not guarantee any particular result.

In particular, ARMTED does not guarantee:

  • any minimum number of impressions;
  • any minimum number of views;
  • clicks;
  • reactions or engagement;
  • messages or enquiries;
  • followers;
  • bookings;
  • leads;
  • transactions;
  • sales;
  • revenue;
  • business opportunities;
  • ranking or placement for any particular period or position; or
  • any other commercial or non-commercial outcome,

unless a specific measurable result is expressly guaranteed in the description of the particular Paid Service purchased.

Performance may depend on numerous factors outside ARMTED’s control, including user interest, location, market conditions, relevance, competition, availability, user preferences and the operation of ranking or recommendation systems.

10. PROMOTION DOES NOT AFFECT COMPLIANCE REQUIREMENTS

Purchasing a Paid Service does not give content preferential treatment for moderation, legality, safety or compliance purposes.

Paid and promoted content remains subject to all applicable ARMTED rules, including the Terms of Service, Community Guidelines, Listing Policy, Firearms Listing Policy and other applicable policies.

ARMTED may review, restrict, reject, remove or disable paid or promoted content on the same or stricter grounds applicable to other content.

Payment does not create a right to publish, retain or promote content that violates applicable law or ARMTED rules.

11. REMOVAL OF PAID OR PROMOTED CONTENT

If content associated with a Paid Service is removed, restricted, suspended, made ineligible for promotion or otherwise affected because:

  • it violates applicable law;
  • it violates the Terms of Service;
  • it violates Community Guidelines;
  • it violates the Listing Policy;
  • it violates the Firearms Listing Policy;
  • it violates another applicable ARMTED policy;
  • information provided by the user is false or misleading;
  • the relevant account is suspended or terminated;
  • the user is not legally or contractually eligible to publish the content; or
  • the user otherwise breaches obligations applicable to the Paid Service,

ARMTED may terminate or suspend the related Paid Service.

To the maximum extent permitted by applicable law, no refund, reimbursement, credit or extension will be provided for any unused portion of the Paid Service in such circumstances.

This does not affect any non-waivable rights available to you under applicable law.

12. USER PROFILE VERIFICATION

ARMTED may offer a paid service allowing a user to request verification of their profile, identity, status, credentials or other information.

Payment of a verification fee is a fee for the verification process or service and does not guarantee successful verification, unless expressly stated otherwise before purchase.

ARMTED may refuse, suspend, revoke or remove verification where:

  • the information submitted is insufficient;
  • information cannot reasonably be verified;
  • information is false, misleading, outdated or inconsistent;
  • the user fails to satisfy applicable verification criteria;
  • fraud or impersonation is suspected;
  • the account violates ARMTED rules;
  • verification is no longer accurate or appropriate; or
  • ARMTED is required to do so by law or for security or compliance reasons.

Unless required by applicable law or expressly stated otherwise before purchase, an unsuccessful verification does not automatically entitle the user to a refund where the verification process has already been performed.

A verification badge, status or other indicator does not constitute a guarantee by ARMTED of a person’s trustworthiness, competence, legality, reputation or future conduct.

13. FIREARM VERIFICATION

ARMTED may offer paid verification relating to a firearm or other eligible item.

The scope and method of verification will be described as part of the relevant service.

Unless ARMTED expressly states otherwise, firearm verification does not constitute:

  • certification of legal ownership;
  • confirmation that a firearm may legally be possessed, transferred, sold, purchased, imported or exported;
  • authentication for governmental or regulatory purposes;
  • a firearms licence, permit, registration or official record;
  • legal advice;
  • a guarantee of mechanical condition, safety or fitness for use;
  • a complete forensic examination;
  • a guarantee of provenance, value or authenticity beyond the scope expressly stated for the verification service; or
  • approval of any transaction involving the firearm.

The user remains responsible for compliance with all applicable laws and for obtaining any legally required licences, permits, registrations, checks, professional inspections or other authorisations.

Payment for firearm verification does not guarantee a positive or conclusive verification result.

ARMTED may decline to issue, suspend or withdraw a verification where the available evidence is insufficient, inconsistent, unreliable or indicates possible fraud, illegality or other material concerns.

14. BOOKINGS AND BOOKING-RELATED FEES

ARMTED may in the future charge fees in connection with bookings made or facilitated through the platform.

Any applicable booking fee, service fee or other charge will be disclosed before the booking or purchase is confirmed.

Booking-related services may also be subject to the ARMTED Booking Terms and to terms imposed by the business, venue, range, service provider or other third party providing the booked service.

Unless expressly stated otherwise, payment of an ARMTED booking-related fee does not make ARMTED the provider of the underlying booked service.

Cancellation, refund, rescheduling and no-show rules applicable to the underlying booking may differ from rules applicable to an ARMTED fee and will be presented or referenced where appropriate.

15. ARMTED PARTNERS AND BUSINESS PAID SERVICES

ARMTED may provide Paid Services to businesses, organisations, ranges, clubs, stores, service providers and other users of ARMTED Partners.

Such services may include enhanced profiles, promotional functionality, advertising, additional management tools, listing functionality, booking functionality or other business features.

Additional ARMTED Partners Terms or product-specific conditions may apply.

Where a person purchases a Paid Service on behalf of a business or organisation, that person represents that they are authorised to make the purchase and bind the relevant business or organisation to the applicable terms.

16. ADVERTISING AND SPONSORED CONTENT

ARMTED may offer advertising, sponsored content and other commercial visibility services.

Advertising services may be subject to additional requirements concerning:

  • permitted advertisers;
  • permitted products and services;
  • targeting;
  • content;
  • geographic availability;
  • regulated products;
  • disclosure and labelling;
  • technical specifications; and
  • applicable advertising law.

ARMTED may refuse, suspend or terminate advertising that it reasonably determines violates applicable law, ARMTED policies, third-party platform requirements or ARMTED’s advertising standards.

ARMTED does not guarantee any particular advertising performance unless expressly agreed otherwise.

17. PACKAGES AND BUNDLES

ARMTED may offer packages containing multiple Paid Services or units of functionality.

The applicable package description will specify the relevant contents, limits, validity period and other material conditions.

Unless expressly stated otherwise, unused elements of a package:

  • have no cash value;
  • cannot be transferred to another user;
  • cannot be exchanged for another Paid Service; and
  • expire when the applicable package validity period ends,

subject to mandatory applicable law.

18. MODIFICATION OR DISCONTINUATION OF PAID SERVICES

ARMTED may modify, replace, limit, suspend or discontinue Paid Services, including their functionality, presentation, eligibility criteria or availability.

ARMTED may also introduce new Paid Services or discontinue existing ones.

Where a material change prevents ARMTED from providing a Paid Service that has already been paid for, ARMTED may, as appropriate and subject to applicable law:

  • continue providing the purchased service until the end of its applicable period;
  • provide substantially equivalent functionality;
  • provide an appropriate credit; or
  • refund an appropriate amount corresponding to the affected part of the Paid Service.

ARMTED is not required to provide a refund or credit where the inability to provide the service results from the user’s breach of applicable law, these Paid Services Terms, the Terms of Service or another applicable ARMTED policy.

19. TECHNICAL INTERRUPTIONS

ARMTED does not guarantee uninterrupted or error-free availability of Paid Services.

Paid Services may be temporarily unavailable because of maintenance, technical failures, security incidents, third-party infrastructure, network failures, legal requirements or circumstances beyond ARMTED’s reasonable control.

Temporary interruptions that do not materially deprive you of the purchased Paid Service do not automatically entitle you to a refund.

Where a significant interruption materially prevents ARMTED from providing a Paid Service, ARMTED may provide an extension, replacement, credit or refund where appropriate or required by applicable law.

20. REFUNDS

Except where required by applicable law, expressly stated before purchase or expressly provided in these Paid Services Terms, payments for Paid Services are non-refundable once the relevant service has begun or has been performed.

In particular, refunds will generally not be provided because:

  • the Paid Service did not achieve the result the user expected;
  • promoted content received fewer views, interactions or enquiries than expected;
  • the user changed their mind after the service began;
  • the user no longer wishes to publish or promote the relevant content;
  • the user voluntarily deletes the relevant content or account;
  • the relevant content becomes unavailable because of an action attributable to the user;
  • verification does not produce the result expected by the user after the verification service has been performed; or
  • ARMTED removes or restricts content or an account because of a violation of applicable law or ARMTED rules.

Nothing in this section excludes statutory refund, withdrawal or other consumer rights that cannot lawfully be excluded.

21. EU/EEA CONSUMERS — RIGHT OF WITHDRAWAL

If you are a consumer in the European Union or European Economic Area, you may have a statutory right to withdraw from a distance contract within 14 days without giving a reason, subject to exceptions and conditions provided by applicable consumer law.

Where you request that ARMTED begin providing a Paid Service before the expiry of the statutory withdrawal period, ARMTED may ask you to expressly request immediate performance.

Where applicable law permits:

  • if the service has been fully performed after your express request for performance to begin during the withdrawal period and after the legally required acknowledgement concerning loss of the right of withdrawal, you may lose your right to withdraw once the service has been fully performed; and
  • if you withdraw after requesting that performance begin but before the service has been fully performed, you may be required to pay an amount proportionate to the services already supplied, where permitted by applicable law.

For digital content or other categories of digital performance, different statutory rules concerning commencement of supply and loss of the right of withdrawal may apply.

ARMTED will present any legally required request, consent, acknowledgement or information during the purchase process where applicable.

Nothing in these Paid Services Terms limits mandatory consumer rights available under EU, EEA or national law.

22. CHARGEBACKS AND PAYMENT DISPUTES

If you believe that a payment was made incorrectly or without authorisation, you should contact ARMTED or the relevant payment provider promptly.

You must not knowingly initiate a fraudulent, abusive or unjustified chargeback.

Where ARMTED reasonably determines that a chargeback, payment dispute or reversal is fraudulent or abusive, ARMTED may take appropriate action permitted by applicable law, including:

  • suspending the relevant Paid Service;
  • restricting further purchases;
  • suspending associated account functionality; or
  • seeking payment of amounts lawfully owed.

Nothing in this section limits legitimate rights to dispute unauthorised or incorrectly processed transactions.

23. FRAUD, ABUSE AND CIRCUMVENTION

You may not misuse Paid Services or payment functionality.

Prohibited conduct includes:

  • payment fraud;
  • use of stolen or unauthorised payment methods;
  • manipulating promotional systems;
  • exploiting technical errors to obtain Paid Services without proper payment;
  • creating accounts to improperly obtain promotional benefits;
  • reselling non-transferable Paid Services without authorisation;
  • attempting to circumvent eligibility, payment or geographic restrictions; or
  • otherwise abusing ARMTED’s payment or promotional systems.

ARMTED may cancel or suspend affected Paid Services and take appropriate account action where such conduct is reasonably suspected or established.

24. PURCHASES THROUGH THIRD-PARTY PLATFORMS

Where a Paid Service is purchased through an app store or another third-party platform, the third party may be responsible for processing the payment and may impose additional purchase, billing, cancellation or refund rules.

Where mandatory rules of the relevant platform apply to a payment, those rules may govern the processing of the relevant refund or payment dispute.

ARMTED is not responsible for payment processing decisions made independently by third-party payment providers, except to the extent required by applicable law.

25. BUSINESS USERS

If you purchase a Paid Service for purposes related to your trade, business, craft or profession, consumer-specific rights may not apply to you.

Business users remain responsible for:

  • ensuring that purchases are properly authorised;
  • maintaining accurate billing and tax information;
  • complying with applicable tax and accounting obligations;
  • ensuring that advertising and commercial content complies with applicable law; and
  • ensuring that employees, representatives and administrators use Paid Services in accordance with applicable ARMTED terms.

Additional Business or ARMTED Partners Terms may apply.

26. TRANSFER AND RESALE

Unless ARMTED expressly permits otherwise, Paid Services are associated with the account, content, business or other resource for which they were purchased.

Paid Services may not be transferred, resold, sublicensed or exchanged between users, accounts, listings or other resources without ARMTED’s permission.

ARMTED may provide specific functionality allowing transfers or reassignment in the future, in which case the conditions displayed for that functionality will apply.

27. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, ARMTED will not be liable for indirect, incidental, consequential or purely economic losses resulting from:

  • expected commercial results not being achieved;
  • loss of expected views, engagement, enquiries, bookings, customers or sales;
  • decisions made by other users;
  • actions of third-party payment providers;
  • temporary interruptions;
  • user-provided information;
  • third-party content; or
  • circumstances outside ARMTED’s reasonable control.

Nothing in these Paid Services Terms excludes or limits liability that cannot legally be excluded or limited, including any liability or consumer remedy protected by mandatory applicable law.

28. CHANGES TO THESE PAID SERVICES TERMS

ARMTED may update these Paid Services Terms from time to time, including because of:

  • changes to Paid Services;
  • new products or functionality;
  • changes to payment methods;
  • changes in applicable law;
  • regulatory requirements;
  • security or fraud prevention requirements; or
  • changes to ARMTED’s business model.

The current version and effective date will be displayed with these Paid Services Terms.

Where ARMTED makes a material change requiring renewed acceptance, ARMTED may require you to accept the updated Paid Services Terms before purchasing or using further Paid Services.

Unless required by applicable law, updated terms will not retroactively alter the material economic terms of a Paid Service already purchased.

29. RELATIONSHIP WITH OTHER ARMTED TERMS

Depending on the Paid Service, your purchase or use may also be governed by:

  • ARMTED Terms of Service;
  • Community Guidelines;
  • Listing Policy;
  • Firearms Listing Policy;
  • Booking Terms;
  • ARMTED Partners / Business Terms;
  • Privacy Policy;
  • Cookie Policy;
  • Copyright / IP Policy;
  • product-specific terms or disclosures; and
  • applicable regional or market-specific supplements.

You must comply with all terms and policies applicable to the relevant account, content, service or activity.

30. GOVERNING LAW AND MANDATORY RIGHTS

The governing law and dispute resolution provisions contained in the ARMTED Terms of Service apply to these Paid Services Terms unless different rules are expressly stated in an applicable regional supplement.

If you are a consumer, nothing in these Paid Services Terms deprives you of the protection of mandatory provisions of the law applicable to you that cannot contractually be excluded.

Regional or country-specific supplements may modify or supplement these Paid Services Terms where necessary.

31. GENERAL PROVISIONS

If any provision of these Paid Services Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law.

A failure by ARMTED to enforce a provision does not constitute a waiver of that provision or any other right.

Headings are provided for convenience and do not affect interpretation.

These Paid Services Terms, together with the Terms of Service and any applicable product-specific or regional terms, form the applicable contractual framework governing Paid Services.
